RULES OF THE "9TH BIRTHDAY 366 CONCEPT" CONTEST

I. General Provisions

  1. This regulation (hereinafter referred to as the "Regulation") sets out the terms and conditions for conducting the "9th Birthday 366 Concept" contest (hereinafter referred to as the "Contest") on the 366 Concept profile on Instagram.
  2. The organizer of the contest is 366 Concept sp. z o.o., with its registered office in Warsaw, at Bagatela 10/5, 00-585, NIP 7011023014, REGON 388332069, KRS: 0000886563 (hereinafter referred to as the "Organizer").
  3. The prize sponsor is 366 Concept sp. z o.o., with its registered office in Warsaw, at Bagatela 10/5, 00-585, NIP 7011023014, REGON 388332069, KRS: 0000886563 (hereinafter referred to as the "Prize Sponsor").
  4. The contest is not a game of chance, a lottery, a promotional lottery, or a mutual bet as defined in the Act of November 19, 2009, on gambling (Journal of Laws of 2009, No. 201, item 1540). Participation in the Contest is free and voluntary.
  5. Instagram provides only the infrastructure that enables the organization of the Contest. Instagram does not sponsor or participate in the organization of the Contest and, therefore, is not responsible for any actions of the Organizer and the consequences of conducting the Contest on the Service.
  6. The contest is aimed at adult individuals ("Participants") who have:
    1. a private account on the Instagram platform;
    2. only one genuine personal account on the Instagram platform;
    3. follow the 366 Concept profile on Instagram;
    4. adhere to the Instagram terms of service, available at https://help.instagram.com/581066165581870;
    5. By participating in the Contest, the individual declares that they have read the Regulation and accept all of its provisions
  7. The right to participate in the Contest is granted to Participants who meet the participation conditions specified in the Regulation.

II. Contest Rules

  1. Participation in the Contest is voluntary and free of charge.
  2. The contest task is available on the 366 Concept brand profile at: https://www.instagram.com/366concept/.
  3. The subject of the Contest is the selection of 1 winner from among the Participants who will present a photo of their home (referred to as the "Submission"), publish it in Instagram Post format on their profile, tag the @366concept profile (instagram.com/366concept), and indicate which chair or pair of chairs from the 366 Concept offer they would like to see in that interior.
  4. The Participant who creates the most interesting Submission ("Winner") will receive a prize.
  5. The condition for participation in the Contest is the publication of the Submission through a post with a photo on the Participant's profile on the Instagram platform, tagging the @366concept profile (instagram.com/366concept).

III. Copyright

  1. By participating in the Contest, the Participant declares that they are the author and hold the copyright to the Submission mentioned in point II, paragraph 4, and that the components of the Submission do not infringe the rights of third parties (excluding works mentioned in point III, paragraphs 1 and 2).
  2. The Organizer reserves the right to verify the accounts of Participants and Submissions.
  3. In case of a well-founded suspicion of fraud, infringement of third-party copyrights or other third-party rights, as well as other violations of the Regulation and the Instagram terms of service, the Organizer may decide to disqualify the Submission or Submissions of the Participant in the contest. Suspected violations should be reported to hello@366concept.com.
  4. In exceptional cases, the Organizer reserves the right to invalidate the Contest.

IV. Prizes in the Contest

  1. The Winner selected based on the Regulation will receive a chair from the Stefan series as indicated in the Submission.
  2. The Organizer of the Contest and the Prize Sponsor allocate the prize to Participants based on their subjective evaluation of the Submissions and the provisions of the Regulation.
  3. The prize will be sent to the address provided by the Winner within ten weeks from the date of Contest resolution, provided that the Winner specifies the desired finish of the chair or pair of chairs, i.e., fabric group and color, as well as wood finish.
  4. Participants are not entitled to receive a cash or material equivalent of the prizes, nor the right to assign the right to receive the prize.
  5. Prizes that have not been won or prizes to which the winner has lost the rights for reasons specified in the Regulation remain at the discretion of the Organizer.
  6. The Organizer is not responsible for providing incorrect address data by the Contest participant. The return of properly addressed shipment according to the data provided by the Contest participant results in the forfeiture of the prize, which becomes the property of the Organizer.

V. Contest Duration

  1. The Contest runs from October 3, 2023, at 17:00 to October 16, 2023, at 23:59.
  2. The Contest results will be announced within 7 days from the end of the Contest on the 366 Concept profile on the Instagram platform.
  3. The Organizer reserves the right to change the above-mentioned dates, and undertakes to promptly inform the Participants through an announcement on the 366 Concept profile on the Instagram platform in accordance with the provisions of the Regulation.

VI. Contest Committee

  1. To ensure the proper organization and conduct of the Contest, especially to assess the correctness of contest submissions and select the winners, the Organizer will appoint a Contest Committee. The Contest Committee will consist of individuals delegated by the Organizer.
  2. The result of the Contest is influenced solely by the actions of the Participants assessed in accordance with the Regulation - excluding any elements of chance.
  3. The Organizer does not guarantee that participation in the Contest will result in winning for a specific Participant.

VII. Complaints Procedure

  1. The Organizer reserves the right to verify whether the awarded Participant meets the conditions specified in the Regulation. To do so, the Organizer may request the Participant to make specific statements, provide specific data, or submit specific documents. Failure to meet the Contest conditions or refusal to fulfill the above-mentioned requests will result in the exclusion of the Participant from the Contest, with the simultaneous expiration of the right to the prize and any other claims against the Organizer. Participants who provide false identification data in the form will be automatically removed from the Contest.
  2. The Organizer is not responsible for the improper operation or interruptions in the operation of the Internet network, as well as for the inability or difficulties in receiving the prize due to reasons on the part of the Contest participant awarded.
  3. Complaints about the course of the Contest can be submitted electronically to the email address: hello@366concept.com, no later than 7 days from the date of announcing the Contest results.
  4. The right to file a complaint is granted only to Participants.
  5. Complaints submitted within the deadline are considered by the Organizer within 14 days from the date of delivering the complaint to the Organizer. Complaints submitted after the deadline or not meeting the conditions specified in the Regulation will not be considered.
  6. The decision of the Organizer regarding the complaint is final and binding. Notification of the Participant about the Organizer's decision will be sent to the address provided in the complaint within 7 days from the date of reviewing the complaint.

VIII. Personal Data

  1. By participating in the Contest, the Winner expresses consent to the processing of their personal data by the Organizer and the Prize Sponsor for the purposes of the Contest.
  2. The Administrator of the personal data provided by the Contest participants is the Organizer of the Contest and the Prize Sponsor.
  3. Personal data will be processed in accordance with the provisions of the Act of August 29, 1997, on the protection of personal data (consolidated text: Journal of Laws of 2002, No. 101, item 926, as amended), for the purposes of organizing the Contest, awarding the prizes, and informing about the Contest results.
  4. The Winner has the right to access their data and request their deletion. To do so, you should submit a written request to the Organizer.
  5. The personal data of the Winner is processed solely for the purpose of awarding the prizes and considering the Winner's complaints. By providing their personal data, the Winner expresses consent to their processing.

IX. Changes to the Regulation

  1. The Contest Regulation is available to Participants at the Organizer's office and on the 366 Concept profile on Instagram.
  2. The provisions of the Regulation are the exclusive basis for conducting the Contest, and their interpretation belongs solely to the Contest Committee.
  3. The Organizer reserves the right to change the Regulation, to the extent permitted by applicable law, and in case of significant reasons related to the technical or substantive aspect of the Contest operation.
  4. Changes to the Regulation will be made available on the 366 Concept profile on Instagram, and communicated to Users in a way that allows for an analysis of these changes.
  5. In case of non-acceptance of the changes, the User should immediately notify the Organizer of such a decision by email to hello@366concept.com.

X. Final Provisions

  1. The pursuit of claims in court may only occur after exhausting the complaint procedure provided in this Regulation and after exhausting the possibility of amicably resolving the dispute.
  2. In matters not regulated, the provisions of the Civil Code and other applicable legal regulations shall apply.
  3. The court having jurisdiction to settle disputes arising from the Contest is the court having jurisdiction over the seat of the Organizer.
